Sexual Violence and People with Disabilities

Summary:

Staff attorneys from Disability Rights Pennsylvania will present a webinar addressing issues relating to sexual violence against individuals with intellectual disabilities.  The webinar will strive to provide participants with an understanding of intellectual disability; the prevalence and causes of sexual violence against individuals with disability; capacity of individuals with intellectual disabilities to consent to sex; special issues in working with and interviewing individuals with intellectual disabilities who are victims of sexual violence; an overview of guardianship and how guardianship may impact victims of sexual violence; and the availability of various legal options to protect individuals with intellectual disabilities who are victims of sexual violence.

This webinar has been approved by PCCD for 1.5 training hours.  After the webinar, you will receive an email verifying your participation in the webinar.  This email will serve as your proof of participation.

Presenters:

Robin Resnick graduated from the University of Pennsylvania School of L^aw in 1986.  She has been a staff attorney with Disability Rights Pennsylvania and its predecessors since 1993.  She has worked on a variety of cases to promote the full inclusion of people with disabilities in community life, including cases to secure community alternatives for people with developmental disabilities and mental illness who are unnecessarily institutionalized; to address wrongful denials of Medical Assistance benefits for people with disabilities; and to remedy disability discrimination in housing, government services, and public accommodations.

Shari Mamas received her B.S. from the University of Pittsburgh in 1993 and her J.D. from the University of Pittsburgh School of Law in 1996.  Prior to joining Disability Rights Pennsylvania (formerly Disability Rights Network of PA) in 2007, Ms. Mamas was a staff attorney for the Education Law Center - PA who assisted parents of children with disabilities to access special education and related services in Pennsylvania public schools.  As a staff attorney for Disability Rights Pennsylvania, Ms. Mamas shifted her focus to advocating for adults with developmental and intellectual disabilities on a wide range of disability-related issues, including accessing appropriate community-based public services, maintaining personal autonomy in decision-making, and protection from abuse and neglect.  

Ms. Resnick and Ms. Mamas co-authored DRP’s publication, Consent, Capacity, and Substitute Decision-Making, with funding from the Developmental Disabilities Council.  The publication, available on DRP’s website, addresses issues relating to the capacity of individuals with disabilities to provide consent and describes various forms of substitute decision-making for health care decisions, financial decisions, and education decisions.  Ms. Resnick and Ms. Mamas also worked with the Temple Institute on Disabilities to develop training materials for investigators charged with implementing the Adult Protective Services Act, including materials relating to available legal interventions.  Ms. Resnick and Ms. Mamas have provided trainings on guardianship and other forms of substitute decision-making to individuals with disabilities, their families, and service providers.
